（一）合同序言

要素：合同双方即雇佣方与被雇佣方（the employer and the employee）

雇佣关系声明（statement of employment relationship）

（三）受聘方义务

要素：周工作时间（working time per week）

日工作时间（working hours per day）

加班（overtime）

法定休息时间（official rest days）

带薪假期（paid vacations）

按期完成工作任务，保证工作质量。

Party B shall complete the tasks greed on schedule and guarantee the quality of work.

未经聘方同意，不得兼任与聘方无关的其他劳务。

Without Party A’s consent,Party B shall not render service elsewhere or hold concurrently any post unrelated to the work agreed on with Party A.

受聘方每周工作_______天，即每月平均工作________天。

Party B shall work_______days a week,i.e._______days a month on average.

不应由受聘方负责的暂时停工。例如，材料短缺、天气恶劣、停电等，应作为实际开工时间，并付给金额工资。

Suspension of work due to causes for which Party B are not responsible,e.g.short supply of materials,bad weather,stoppage of electricity,etc.shall be charged as actual working hours with full pay.

（四）聘方义务条款

（4）薪酬支付（Payment of Salary）。

（5）提供保险（Buying Insurance）。

（五）薪金支付条款

支付时间（按月/年；by mouth/year）

支付币种（in…）

聘方每月（日、年）支付给受聘方薪金______美元。

The Engaging Party pays the Engaged Party a salary of U$________by month（day，year）.

聘方每月支付受聘方工资________欧元，并按照________（国家）政府对在_______工作的外籍专家的规定提供各种福利待遇。

The Engaging Party pays the Engaged Party a monthly salary of_______Euros and provide various benefits as prescribed by（country）for foreign experts working in_________.

（六）福利条款

福利条款一般关于保险和医疗服务的比较多。

聘方应自费为人员向________保险公司投保海外旅行事故险。

Party A shall,at his own cost,effect Overseas Travel Accident Insurance for the Personnel with_________Insurance Company of________.

受聘方如因工受伤，聘方应提供治疗，并给予带薪病假15～25天，如因违反操作规程负伤，其医药费应由受聘方承担。

In case Party B is injured in an accident while at work.Party A shall give him medical treatment and 15～25 days’sick leave with full pay.In case the injury results from violation of operation regulations.Party B shall be responsible for the expenses of his medical treatment.

（七）修改、终止合同

要素：

合同有效期（validity of the contract）；

修改合同（revision of the contract）；

终止合同（terminate the contract）；

承担责任（be liable to；be responsible for）；

补偿措施（compensation measures）。

双方应信守合同，未经双方一致同意，任何一方不得擅自更改、解除和终止合同。

Both parties should abide by the contract and should refrain from revising,cancelling,or terminating the contract without mutual consent.

如受聘方中途提出辞职，聘方自同意之日起即停发工资，受聘方不再享有各种待遇。

If the Engaged Party submits his resignation in the course of his service the Engaging Party shall stop paying the Engaged Party the salary from the day when his resignation is approved by the Engaging Party,and the Engaged Party shall no longer enjoy the salary and benefits stipulated.

本契约期间届满当然失效，如因业务需要须续聘时，另行签订新契约。

At the expiration of the term of this agreement,the employment relationship shall automatically terminate without any condition.A new employment agreement shall be signed for the renewal and continuance of such relationship,if agreed to any by both parties.

（八）仲裁条款

要素：争议及解决（dispute/controversy and solution）

相关法律（governing laws）

友好商议（friendly negotiation）

申请仲裁（apply for/ask for arbitration）

仲裁机构（organization of arbitration）

本合同纠纷应依照_________法处理，以________法院为第一审管辖法院。

Any dispute or controversy between the parties with respect to this Contract shall be determined in accordance with the laws of_______.The parties hereby submit and consent to the non-exclusive jurisdiction of_________Court.

（九）合同结语

本合同以中文文本为准。如中、英文文本互相歧异或抵触时，以中文文本为准。

The Chinese text of this Contract shall be deemed the original.In the event of any dispute or misunderstanding as to the interpretation of the language or terms of this Agreement,the Chinese language version shall control.

本合同一式三份，三方各持一份。
