第九条 公司按国家相关法令实施工时制度。需实行综合工作制或不定时工作制的应报劳动部门批准。员工根据公司安排加班的,公司将予以安排调休或依法定标准给予加班工资。加班工资根据《上海市企业工资支付办法》的相关规定计算。双方另有约定的,该约定内容将作为本合同的附件。

Article Nine The Company shall follow the working hour rules defined by related Chinese laws.Approval from labor department shall be obtained in cases where comprehensive working hour system or flexible working hour system must be implemented.The Parties confirm that the senior management level employee shall be the sales manager and above level employee.If an employee works overtime as required by the Company,the Company will arrange day-off or make overtime payment to the employee at the rate required by law.The overtime working salary should be calculated according to“Measures on Shanghai Enterprise Salary Payment”.If otherwise agreed by both Parties,the further agreed contents shall be set forth as the Exhibit of this Contract.

第十条 员工应自觉遵守劳动纪律,遵守公司的规章制度。

Article Ten Employees shall consciously observe labor discipline and abide by Company rules.

第十一条 员工有按照国家及上海的有关规定享受各种假期(婚假丧假〈包括配偶父母〉、产假、晚育护理假、工伤假、病假等)和休假的权利。(www.xing528.com)

Article Eleven Employees have the right to observe all holidays(marriage leave,funeral leave〈including the parents of spouse〉,maternity leave,nursing leave,working injury,sick leave,etc.)and rest days according to the State or Shanghai rules.

第十二条 公司依法实行法定年休假及企业假制度:员工为公司连续工作满一年以后:(1)若累计工作已满1年不满10年的,除享受法定年休假5天外,若属于员工级别的,还可享受企业假7天,若属于管理人员级别的,还可享受企业假10天;(2)若累计工作已满10年不满20年的,除享受法定年休假10天外,若属于员工级别的,还可享受企业假2天,若属于管理人员级别的,还可享受企业假5天;(3)若累计工作已满20年的,仅享有法定年休假15天。年休假在一个年度内可以集中使用,也可分段使用,一般不得跨年度使用。

Article Twelve The Company adopts a policy of legitimate paid annual and enterprise leave.After the employee works continuously for the Company for one year:(1)if the employee has worked accumulatively for more than one year(inclusive)and less than ten years,a legitimate paid annual leave of five days shall be taken and also the enterprise leave an enterprise leave of seven days shall be taken by employee level,and an enterprise leave of ten days shall be taken by manager level;(2)if the employee has worked accumulated more than ten years and less than twenty years,a legitimate paid annual leave of ten days shall be taken and an enterprise leave of two days shall be taken by employee level,and an enterprise leave of five days shall be taken by manager level;(3)if the employee has worked accumulatively for more than twenty years(inclusive),only a legitimate paid annual leave of fifteen days shall be taken.Annual leave can be either concentratively used in a year or be used separately,but generally it shall not use across the year.

第十三条 培训时间(系指公司安排的培训)应算作上班时间。

Article Thirteen Training time(means the training arranged by the Company)should be included in working time.
